Carbon Mapper Terms of Use

1.  Introduction and Acceptance

These terms of use together with our Privacy Policy and any supplemental terms or policies referenced herein or that point to this document (collectively, the “Terms”), form a binding contract between you and Carbon Mapper, Inc. (“Carbon Mapper”, “we”, “our” or “us”). The Terms govern your access to and use of our website at https://carbonmapper.org/ (the “Site”) and any online services, including any content, functionality, and services (collectively with the Site, the “Service”) offered on the Site or via our API.

Please read these Terms carefully before using the Service. BY USING THE SERVICE, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE SERVICE.  If you use the Service on behalf of a legal entity, then you represent that you have authority to bind that legal entity to these Terms and that the legal entity accepts these Terms. 

2.  Accessing the Service

2.1  Registration Requirements and Eligibility

You may be required to register for an account (“Account”) to access certain features of the Service.  You must be at least 18 years old (or if higher, the age of majority in your jurisdiction of residence) (the “Minimum Age”) to register. When registering, you agree to:

  • Provide and maintain accurate, current, and complete information.  You must ensure that your Account reflects your current information.  You must not provide any false information or impersonate another person or entity through your Account. 
  • Be responsible for your Account.  You must maintain the confidentiality and security of your password and Account.  You will notify us immediately of any unauthorized use of your Account.  

You may use the Service if you are under the Minimum Age if and only if you have the permission of your parent or legal guardian to use the Service. Your use of the Service must be subject to their supervision and control, and your parent or legal guardian must read these Terms with you. 

2.2  Termination or Suspension of your Account

You may terminate your Account with us at any time; however, we may retain some of your content and historical information for legal and backup reasons. 

We may terminate or suspend your Account for any reason, without notice unless legally required.  We may terminate your Account if we suspect you are engaging in fraud, illegal activity or other violation of these Terms.

Accounts with no activity for 12 consecutive months may be deemed inactive.  We may close inactive accounts after providing notice to the email address associated with the account. 

2.3  Privacy

Registration information will be used for account management and service provision, as well as other uses permitted by applicable law.  We may collect technical information about your use of the Service for operational and improvement purposes.

2.4  Prohibited Uses 

You may not:

  • Use the Service for any illegal purpose or in violation of applicable laws
  • Misrepresent or alter Carbon Mapper data in misleading ways
  • Impersonate Carbon Mapper, its employees, or other users
  • Interfere with, disable, or damage the Service or other users' access
  • Use automated tools (bots, scrapers, etc.) that impair Service performance
  • Introduce malicious code or attempt unauthorized access
  • Attack the Service through denial-of-service or similar methods
  • Copy or use data beyond what these Terms expressly permit
  • Engage in conduct that harms Carbon Mapper or exposes it to liability

2.5  Service Modifications

Carbon Mapper may, at its sole discretion and without notice:

  • Modify, suspend, or discontinue any portion of the Service, content made available therein, features, or other data products
  • Change data formats, APIs, access methods, or technical specifications
  • Add, remove, or modify data sources, processing methods, or analytical tools
  • Update system requirements, interfaces, or functionality

We make no commitment to maintain any specific functionality or data availability.

3.  Content License

3.1  License Grant

Subject to these Terms, Carbon Mapper grants you a worldwide, limited, non-exclusive, non-sublicensable, non-transferable, revocable license to:

  • Access, use, reproduce, publish, make derivative works (“Derivative Works”) of, and display Carbon Mapper's data and content made available via the Service (“Data”); and
  • Distribute the Content and any such Derivative Works to third parties.

You may export data for use in external applications provided such use complies with these Terms, including attribution and non-commercial use requirements.

3.2  Non-Commercial Use; Purpose

The license set forth in these Terms may be exercised by you on a (a) Non-Commercial basis only, and (b) in furtherance of the Purpose.  Unless otherwise separately agreed by Carbon Mapper, you may not use Carbon Mapper's Data Product(s) for any commercial purpose.

“Non-Commercial” means uses of the Data Product(s) (and associated Derivative Products) from which you will not derive profits (or other consideration) or otherwise obtain a financial advantage by charging a third party in exchange for redistributing products or services that involve your use of the Data Product(s) or Derivative Products.

  • For example: permitted, Non-Commercial uses may include (but are not limited to) the following: (i) limited business use of the Data Product(s) for internal operational purposes to find and fix methane and carbon dioxide emissions, improve processes, or to provide reporting, and in all cases aligned with the Purpose, (ii) a government regulator or policy maker uses Data Product(s) to perform inventory accounting, to enforce mitigation, or to develop policy aligned with the Purpose; (iii) an NGO or journalists use Data Product(s) to support public investigations; or (iv) a research institution uses the Data Product(s) to improve emissions monitoring, reporting, or mitigation.
  • By contrast, non-permitted, commercial uses include (but are not limited to) the following: (i) a data aggregator redistributes Data Product(s) for a fee or as part of a paid membership benefit resulting in commercial value to corporate entities, (ii) a hedge fund uses Data Product(s) to create profitable Derivative Products for commodities trading, with no intention for, or progress towards, achieving the Purpose; (iii) a commercial organization uses Data Product(s) to create Derivative Products (including but not limited to training data for model development) for redistribution and derives profits (or other consideration) or otherwise obtains a financial advantage by charging a third party in exchange for the downstream use of such Derivative Products; or (iv) an NGO or non-profit organization creates a Derivative Product to distribute to its customers for a fee, or as part of a paid membership benefit, each resulting in commercial value to the NGO or non-profit organization.

“Purpose” means the use of the Data Product(s) to drive greenhouse gas emission reductions by making methane and carbon dioxide data accessible and actionable for mitigation, awareness, and/or policy formulation purposes; provided however that the Purpose expressly excludes using the Data Product(s) or Derivative Products for estimates of forest carbon emission and removal fluxes derived from hyperspectral observations.

3.3  Attribution Requirements

You must provide clear attribution to Carbon Mapper in any use, reproduction, or distribution of the Data Product(s) or any Derivative Product. Any of the following forms of attribution are acceptable:

  • “Source: Carbon Mapper”
  • “Data by Carbon Mapper”
  • “Data provided by Carbon Mapper, Inc.”
  • “Source: Carbon Mapper (data.carbonmapper.org)”
  • “Source: data.carbonmapper.org” 

For academic or research use, please cite Carbon Mapper appropriately.

3.4  Share-Alike Provision

Any redistributions by You of the Data Product(s) or any Derivative Products must be made available under the same non-commercial terms and attribution requirements contained in these Terms. If you share data with third parties, you may only do so to recipients under a license on the same (or substantially similar) terms and conditions as the license granted to you under these Terms.

3.5  License Termination

Carbon Mapper may terminate or suspend your license to use the Data Product(s) at any time, with or without cause, with or without notice. Upon termination:

  • You must cease all use of the Data Product(s) and destroy or delete any copies in your possession
  • You may retain and continue to use Derivative Products you created prior to termination, provided such use complies with the attribution requirements and other applicable terms that survive termination
  • You may not create new Derivative Products or distribute existing ones to new recipients after termination

4.  Alternative Licensing

Carbon Mapper may negotiate separate license agreements for certain Data Product(s) for commercial use, enhanced access, or other arrangements outside these Terms. Such agreements supersede these Terms only as specified. For alternative licensing inquiries, contact Carbon Mapper at data@carbonmapper.org.

5.  Data Accuracy and Limitations

5.1  Scientific Data Disclaimers

The Data Product(s) represent scientific measurements and analyses that are subject to inherent uncertainties and limitations. Users should understand that:

  • Satellite and aircraft measurements involve technical uncertainties and processing limitations
  • Data accuracy may vary based on environmental conditions, instrument performance, and processing methods
  • Temporal gaps may exist in data coverage due to weather, technical issues, or operational constraints
  • Measurements represent point-in-time observations and may not reflect average emissions
  • Detection limits vary by sensor type, platform altitude, observing geometry and environmental conditions
  • Unless otherwise separately agreed, data is typically released with some delay after each observation to allow quality control review

5.2  User Responsibility

Users are responsible for:

  • Understanding the limitations and appropriate applications of the Data Product(s)
  • Consulting technical documentation and methodology papers as necessary to interpret each Data Product(s)
  • Not misrepresenting data accuracy or capabilities

6.  Intellectual Property Rights

6.1  Carbon Mapper Rights

Carbon Mapper retains all rights, title, and interest in and to the Service, including the Site and Data Product(s), and all intellectual property rights thereto.

6.2  Trademark Use

Except as otherwise expressly permitted in these Terms, you may not use Carbon Mapper's name, logo, or trademarks without prior written permission.

7.  WARRANTY DISCLAIMER; LIMITATION OF LIABILITY

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE MAKE NO WARRANTY THAT (1) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (2) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE COMPLETE, ACCURATE, OR RELIABLE; OR (3) THE QUALITY OF ANY INFORMATION OR CONTENT OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE TO YOU FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA, OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SERVICE.  CARBON MAPPER'S TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100) FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS.

IN THE EVENT OF ANY PROBLEM WITH THE SERVICE, DATA PRODUCT(S) OR ANY CONTENT, YOU AGREE THAT YOUR SOLE REMEDY IS TO CEASE USING THE SERVICE.

8.  Indemnity

You agree to indemnify, defend, and hold harmless us, our affiliates, officers, directors, employees, agents, and representatives from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your use of the Service, your violation of these Terms, your violation of any third party right or your violation of any applicable laws.

9.  Geographic Restrictions and Export Control

9.1  Geographic Availability

Carbon Mapper makes no representation that the Service is available or appropriate for use outside of the United States. Access to the Service may be restricted in certain countries or jurisdictions.

9.2  Export Compliance

You may not use Carbon Mapper's Data Product(s) or the Service in violation of United States export laws, regulations, or restrictions.

9.3  International Access

If you access the Service from outside the United States, you are responsible for:

  • Compliance with all applicable local laws and regulations
  • Compliance with applicable United States export control laws
  • Any restrictions that may apply based on your location or nationality

9.4  Restricted Parties

You represent that you are not located in, organized under the laws of, or ordinarily resident in any country subject to U.S. economic sanctions, and that you are not identified on any U.S. government restricted party list.

10.  Governing Law and Jurisdiction

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of such courts. Any claims brought by you against Carbon Mapper must be brought within one (1) year after the claim arises or be permanently barred.

11.  U.S. Federal Government Users

If you are using the Service in the capacity of an employee, consultant or representative of any United States government entity, (i) the section entitled “Indemnity” shall not apply to your use of the Service; and (ii) the section entitled “Governing Law and Jurisdiction” shall be replaced in its entirety with the following: “These Terms shall be governed by and construed in accordance with U.S. federal law.”

12.  Feedback

We welcome your feedback, thoughts and comments (“Feedback”) to the Service.  Any Feedback you provide to us may be used by us for any purpose, without acknowledgement or compensation to you.

13.  Updates to These Terms

We reserve the right to modify or amend these Terms from time to time without notice to you.  Changes are effective upon posting, unless otherwise stated.  You are responsible for reviewing any updated Terms. If you continue to use the Service after we post changes to these Terms, it will mean that you accept those modified or amended Terms. 14.  Severability and Waiver

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect, and the unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.  Our failure to enforce any part of the Terms does not constitute a waiver.

15.  Notice and Contact Information

We may provide notices to you within the Service, or if required, via email or mail.  When you use the Service or send us communications, you consent to receive all legally required notices, disclosures, and communications electronically. You confirm that you: (1) can access and read electronic records; (2) consent to receiving electronic communications instead of paper communications; and (3) understand you may withdraw this consent by contacting us, though we may terminate your account if you do so.
